In an interview with CBS News correspondent Jericka Duncan on Thursday, de la Huerta accused Weinstein of raping her twice in her apartment in 2010.

Manhattan's district attorney's office confirmed a senior prosecutor was looking at the case.

De la Huerta told CBS News that the first rape occurred in October 2010 after Weinstein gave her a ride home from a party, insisted on having a drink in her apartment and forced himself on her.

"He hushed me and said, 'Let's talk about this in your apartment, '" de la Huerta recalled to Vanity Fair after she tried to tell Weinstein to leave her alone.

De la Huerta, now 33, told her therapist after the incidents happened.

Then two months later, Weinstein showed up at her building and they went upstairs before he attacked her again, according to the actress.

"The first time I was in complete shock and it happened so quickly". I did say no, and when he was on top of me I said, "I don't want to do this".

"He finished what he did, and he told me he'd be calling me", she said.

She joins dozens of women who have already leveled allegations of sexual abuse against Weinstein.

Boyce said that because Weinstein was out of state the police department would need a court-ordered warrant for any arrest.

"As this is an active investigation", the statement continues, "we will not be commenting further".

"I'm not going to close the door and say others won't come forward but this is what we have right now". NY police told CNN they've fielded dozens of calls about Weinstein.

Police in Los Angeles and London are also investigating rape allegations against Weinstein.

The movie mogul has "unequivocally denied" allegations of non-consensual sex.

Weinstein is in Phoenix for treatment following his recent sex scandal, which cost him his marriage, his reputation and his seat on The Weinstein Company board.
